To ensure the effective implementation of the Data Privacy Act in Davao City, the City Government came out with a new executive order adapting changes in the latest ordinance on the membership of the existing Data Privacy Committee.

Executive Order No. 2, Series of 2025, amended Executive Order No. 30, Series of 2023, which identified the composition of the Data Privacy Committee, who shall perform functions as may be instructed by the City Mayor and/or Data Privacy Officer.

The Sangguniang Panlungsod issued Ordinance No. 0258-23 on October 10, 2023, which operationalized Republic Act No. 10173, or the Data Privacy Act of 2012, in the City Government of Davao (also known as the Data Privacy Ordinance of the City of Davao), and provided funds for it.

“There is a need to amend Executive Order No. 30, Series of 2023, to reflect the members of the Data Privacy Committee indicated in Section 5 A3 of the
abovementioned City Ordinance,” EO 2, Series of 2025 reads.

“There is also a need to add members to said committee and specify its functions and responsibilities, especially in relation to the formulation of internal policies to ensure that all city government offices are fully compliant with the same,” the EO reads.

Section 1 of the EO states the new composition of the Data Privacy Committee.

The Committee will now be chaired by the City Mayor’s Office, the City Legal Office (CLO) as Vice Chairperson, and the Internal Audit Service Division as Secretariat.

The members are City Administrator’s Office, City Administrator’s Office-For Operations, City Administrator’s Office- For Administration, City Information and Technology Center (CITC), City Archives and Records Office (CARO), City Civil Registrar’s Office (CCRO), Sangguniang Panlungsod- Committee on Information Technology, Human Resource Management Office (HRMO), City Social Welfare and Development Office (CSWDO), City Health Office (CHO), City Information Office, City Treasurer’s Office, Office of the City Building Official, and Business Bureau Permits and Licensing Division.

This includes more offices compared to the previous EO, which only named the City Legal Office, City Mayor’s Office, City Administrator’s Office, CITC, CARO, CCRO, HRMO, CSWDO, and CHO as part of the Data Privacy Committee.

Based on Section 2 of EO 2 Series of 2025, the Data Privacy Committee shall formulate, and/or update as applicable, comprehensive policies and procedures that ensure the implementation of RA 10173 across all offices of the City Government of Davao; submit all formulated and updated policies to the Data Protection Officer for the approval and ensure its dissemination to all offices for proper implementation and guidance; review contracts involving processing of data; provide technical advice to the DPO based on their area of expertise; and perform other duties that will be assigned by the DPO.

All employees of the departments, offices, and divisions of the City Government of Davao as well as the Office of the Vice Mayor and Sangguniang Panlungsod shall cooperate with the Committee and shall render full assistance in the sustained compliance with the requirements of the Data Privacy Act of 2012.
