In its desire to put in place effective and impartial system to conduct proper administrative proceedings, to ensure proper observance of due process and avoid delays in the disposition or resolution of complaints against employees, the City Government of Davao reconstitutes its investigating committee.
The City Government, on November 27, 2024, issued Executive Order No. 36, Series of 2024 “An Order Reconstituting the Investigating Committee and its Secretariat, Identifying the Special Administrative Prosecutors, and Defining the Respective Powers, Functions, and Duties Thereof.”
Based on the EO, the reconstitution is done to reflect the changes in its membership, specifically in the Special Administrative Prosecutors and members of the Secretariat.
Section 1 of the EO 37, mandates the composition of the Investigating Committee.
It shall be chaired by the Acting City Legal Officer, Atty Osmundo P. Villanueva Jr. Its members include, Officer-In-Charge of the Human Resource Management Office Ms. Melody C. Herrera and City Accountant Ms. Vingelin Bajan.
Section 2 provides the powers, functions and duties of the IC.
Section 4 provides that all administrative actions shall be prosecuted under the direction and control of a Special Prosecutor. A private prosecutor may be authorized to participate during the administrative proceedings subject to an administrative vote of the Investigating Committee.
The names of Special Prosecutors are also listed under the same section.
